Once you’re arrested you can’t be un-arrested

  • Sunday, July 28, 2013

Police got a call because there was a suspicious car parked in a neighborhood parking lot.

When police arrived, the occupants scattered and took off running. However, they were all wrangled back up and returned to the car.

Police obtained everyone’s information and learned no one was over 21, so the 12 pack of beer in the car was illegal. They said they had been at a party and gotten some random to buy them beer. At this point the officers told the driver she could call her parents to come get her and the car or the car would be towed. She called her parents as did everyone else.

One set of parents explained to officers that their son had been in trouble with alcohol in the past and had even been treated for a high level of alcohol consumption. They both said they did not want to take him home.

At that point the officer had no other choice but to arrest him for public intoxication since he was drunk.

He had already admitted to drinking about five beers and was stumbling around, unsteady on his feet.

Once he was placed in the patrol car his parents asked the officer if they could take it back, referring to the arrest. The officers then told them that once someone is placed under arrest they can not be un-arrested.
