A couple got physical one evening while having relations. They had been out drinking at several bars and even stopped at an all-night diner for breakfast. But as the two were engaging in intercourse, a physical struggle ensued, according to a police report.
Police were notified of this assault from a third party who wanted police to go check on their employee.
When they arrived they found a man with no shirt on standing at the entrance to an apartment complex.
He said his (ex)-girlfriend just assaulted him. He had cuts on his arms, back of the neck and face. His left eye was bruised and swollen. He was asked if he need EMS and he refused. The officer met with the girlfriend who said she was not injured. She said they were in bed when they began to argue about the boyfriend sleeping with her best friend. She said she threw her phone at him. It indeed was cracked along the screen.
She could not tell police who started the struggle, but told the officer she repeatedly asked him to leave.
She said he grabbed her by the neck but there was no indication of it.
His story was that they were having sex when she bopped him over the head with her phone unprovoked.
There were no witnesses or roommates to corroborate the story and, due to the victim’s lack of cooperation, no charges were pressed. The boyfriend got a ride home with a friend.
